This information is used to calculate the calories you burn during an activity and to enable you to show your Connections the types of activities you participate in if you wish. The legal ground for processing this information for these purposes is your consent. You can withdraw your consent by deleting this information from your account profile.

Additional personal data that is processed when you customize or add bike information in your profile:

You can choose to customize the default bike information or add your own bike information in your profile, such as the bicycle make and model, specifications, and a name for the bike.

PURPOSE AND LEGAL GROUND:

This information is used to calculate your performance during indoor cycling activities. The legal ground for processing this information for these purposes is our legitimate interest in giving you the most accurate calculations we can.

Personal data that is processed when you choose to upload your indoor cycling activity data to Garmin:

You can choose to upload your indoor cycling activity data (e.g., distance, duration, cadence, heart rate, power, speed, calories burned, etc.) from your Tacx trainer device to your Garmin account. You can use your Tacx trainer device without providing your consent to upload your activities to Garmin. If you choose to upload your activities to Garmin, you control whether others can see your indoor cycling activity data by managing the privacy settings in your Garmin account. Your indoor cycling activity data is set to “Private” by default.

PURPOSES AND LEGAL GROUNDS:

(a) Garmin processes your indoor cycling activity data, if you choose to upload it to Garmin, to enable you to store and analyze your indoor cycling activity data, identify any Garmin devices used to collect data during the activity, see your heart rate related metrics such as stress score, Body Battery, or pulse oximetry, track your fitness goals, and, if you wish, share your activity data with others. If you reside in the EEA, U.K., or Switzerland, the legal ground for this processing is your explicit consent, which you can withdraw at any time within your Garmin account.

(b) If you choose to upload indoor cycling activity data generated by your Tacx trainer device to your Garmin account and you choose to participate in Insights, then you will be presented with an Insights section in your Garmin account in which you will be provided with recommendations and motivational messages, information and links to articles that may be of interest to you based upon your activity data, and a comparison of your activity data with aggregated activity data of others in the Garmin Connect community. If you reside in the EEA, U.K., or Switzerland, the legal ground for processing this data for this purpose is your explicit consent, which you can withdraw at any time within your Garmin account.

(c) Garmin also processes your indoor cycling activity data, if you choose to upload it to Garmin, in an aggregated manner to analyze usage and trends and develop or improve features and services. The legal ground for this processing is Garmin’s legitimate interest in providing relevant and quality features and services.

(d) If you choose to upload your indoor cycling activity data to Garmin and you are opted in to product improvement, Garmin will process your indoor cycling activity data uploaded to your account for research and development purposes internally to help us build better and more relevant Garmin products and services. If you reside in the EEA, U.K., or Switzerland, the legal ground for processing this data for this purpose is your explicit consent, which you can withdraw at any time within your Garmin account.

Personal data that is processed when you participate in Tacx Challenges through the Tacx website:

If you choose to participate in Tacx Challenges through the Tacx website, we ask you for your full name, email address, mailing address, country, and Tacx Cloud account ID number.

PURPOSES AND LEGAL GROUND:

We process your Tacx Cloud account ID number to review your activity data and verify that you have completed the Tacx Challenge. We process your name, country, and activity data relevant to the Tacx Challenge requirements to add you to the list of Challenge Heroes who have completed the Tacx Challenge and show your completion time and date. We process your name and mailing address to send you a prize if one is offered for completing the Tacx Challenge. The legal ground for processing this information for these purposes is our legitimate interest in promoting engagement and fitness activities of Garmin users, rewarding participation, and celebrating achievement.

Personal data that is processed when you purchase a subscription to the Tacx services:

When you purchase a subscription to the Tacx services, we ask for your full name, email address, and billing address or voucher code, if applicable. A third party, Adyen, processes your payment card information when you purchase a subscription to the Tacx services. More information on Adyen can be found here.

PURPOSES AND LEGAL GROUND:

We process this information to set up your subscription, provide access to the purchased services, and collect payment for the purchased subscription. The legal ground for processing this information for these purposes is performance of a contract.

Personal data that is processed when you download or stream films from the Tacx website:

When you download or stream a film from the Tacx website, we process your account information and the selected content to check your subscription status to provide access to the requested content.

PURPOSES AND LEGAL GROUND:

We process this information to validate your request and supply the requested content if you have a valid purchase or subscription. The legal ground for this processing is performance of a contract.

Personal data that is processed when you communicate with Garmin:

When you interact with our customer support representatives by email or telephone, online, or in person, we collect personal data, such as your name, mailing address, phone number, email address, and contact preferences, and information about the Garmin products you own, such as their serial numbers and dates of purchase, and subscriptions you've purchased. We also may create event logs that are useful in diagnosing product or app performance-related issues and capture information relating to the support or service issue. To improve customer service, subject to applicable laws, we may also record and review conversations with customer support representatives and analyze any feedback provided to us through voluntary customer surveys. With your consent, our customer support representatives may sign in to your Garmin account, if appropriate, to help troubleshoot and resolve your issue.

We use this information to provide you with customer and product support, to monitor the quality and types of customer and product support we provide to our customers, and to facilitate repairs, returns, or exchanges. OTHER GARMIN CONNECT USERS:

Your activities and activity data associated with your Garmin account are set to “Private” by default. You may decide to allow others to view your activities and activity data by changing the privacy settings in your Garmin account. You can join Groups and make Connections with other Garmin Connect users. You may also choose to join other Garmin Connect users in Challenges and Leaderboards. When you interact with others in these ways, you will be displaying your data relating to the Challenge or Leaderboard (e.g., aggregate number of steps during the duration of a steps Leaderboard or Challenge) even if your privacy settings in your Garmin account are set to “Private.”

LIVE OPPONENTS:

If you choose to enable the Live Opponents feature, other users doing the same indoor cycling activity will be able to see your activity performance (such as speed, distance, or power), name, and profile photo.

TACX WEBSITE VISITORS:

When you complete a Tacx Challenge, Tacx website visitors who browse to the page of that Tacx Challenge will see your full name, completion time and date, and country in the list of Challenge Heroes.

CONTENT OR FEATURE PROVIDERS; OTHER THIRD PARTIES:

From time to time, we share or sell activity data in a de-identified and aggregated manner with or to companies that provide Garmin and our customers with content or features for the purpose of enhancing the quality of the content or features they provide and with or to other third parties for research or other purposes.

OTHER SERVICE PROVIDERS:

Garmin uses cloud services from third parties such as Adobe, SendGrid, a Twilio service, Spotler (previously known as MailPlus), and Mandrill, a Mailchimp service, to assist in sending emails. Those services track the activities associated with these emails, such as whether they were opened, whether links in the emails were clicked on, and whether purchases were made following clicks on those links. Garmin uses this data to analyze the level of engagement with its emails.

Garmin uses Kinsta, Google hosting services, and Azure, a Microsoft service, to provide infrastructure and hosting for the Tacx services and website. Garmin also uses Red Factory to maintain the Tacx website.

Garmin also uses third-party service providers to help us better understand usage of the Tacx website, services, and desktop and mobile apps and for related purposes.

OTHER DISCLOSURES:

We may disclose personal data about you to others: (a) if we have your valid consent to do so; (b) to comply with legal obligations, such as a valid subpoena, court or judicial order, or other valid legal process; (c) to enforce any of our terms and conditions or policies; or (d) as necessary to pursue available legal remedies or defend legal claims.

The types of analytical information that are collected include the date and time the app accesses our servers, app version, the location of the device, language setting, what information and files have been downloaded to the app, user behavior (e.g., features used, frequency of use), device state information, device model, hardware and operating system information, and information relating to how the app functions. Garmin uses this data to improve the quality and functionality of these and other apps; to develop and market products and features that best serve you and other users; and to help identify and fix app stability issues and other usability problems as quickly as possible.

If we learn that we have collected personal data from a child under the age of 13 in the U.S. or under 16 in the rest of the world, we will take steps to delete the information as soon as possible.

We may update this Privacy Policy from time to time as we add new products, services, and apps, as we improve our current offerings, and as technologies and laws change.
